If I wanted to live in the desert, I would move to the desert. Instead, I get to live in Pennsylvania where it feels hotter than the desert because of our insane humidity.

And although I like the warm feeling of sun on my skin, I?m not one for humidity. I get that from my mother. But I also don?t like a/c. There is this love-hate battle of not wanting to be in the sweltering heat and not wanting to be in the freezing office or restaurant. What to do?

If it?s going to be this hot, I might as well be on a beach. Or drinking one of these.

Low calorie flavored waters

If you?re looking to save a few calories while still enjoying something a little more lively than plain water. There are plenty of ways to spice things up with fresh fruit or spritzes of juice.

Try mashing fresh leaves of mint and add lime and cucumber slices to a glass of water. Squeeze some of the juices from the lime and cucumber to flavor the water and stir.

Visualized the iDevice influence over Apple's bottom line

Apple's Q3 earnings last week rang loud and clear: iDevices are paying Cupertino's bills. The customary numerics laid down the bare facts, citing an 84 percent increase in iPad sales since 2011 and a similar 28 percent jump for the iPhone. Of course, well-organized tables of sales data aren't for everyone, but who doesn't love a good chart? Stuart Carlton took it upon himself to graph the percentages of Apple's revenue that each of its product categories fill out, producing the above criss-cross of colored statistics. The graph compares Apple's Q3 sales data going back several years, and a second chart (after the break) compares the iPhone, iPad and iPod's share of the revenue directly with the rest of Apple's fare. Hot White Sox defeat slumping Rangers

ARLINGTON, Texas (AP) - Eduardo Escobar made his final contribution for the first-place Chicago White Sox on Saturday night.

Escobar had two hits, including an RBI double in a three-run fifth, in Chicago's 5-2 victory over the Texas Rangers and then was sent to Minnesota in a trade for left-hander Francisco Liriano.

Adam Dunn hit his major league-leading 31st home run and Philip Humber pitched six solid innings in leading the White Sox to their fifth straight victory.

The postgame scene, however, was dominated by the news of Liriano's acquisition. The lefty was traded to Chicago on Saturday night for Escobar and minor league left-hander Pedro Hernandez.

"He's such a good kid," Dunn said of Escobar, "We really enjoyed having him."

Escobar, who started at short in place of Alexei Ramirez, helped the White Sox pull away in a three-run fifth that extended their lead to 5-0.

Jordan Danks singled and came home on Escobar's double. Two batters later, Dunn hit a two-run shot that just cleared the wall in center.

Escobar also doubled in the seventh.

"Everybody loves (Escobar)," Chicago first baseman Paul Konerko said. "He's probably going to play every day and become a household name over there."

Konerko added a two-run homer for Chicago, which increased its AL Central lead to 2 1/2 games over Detroit. The White Sox have won the first two in a three-game series between division leaders.

Humber (5-5) didn't allow a hit through three innings and won for the second time in three starts. He yielded one run, four hits and struck out four.

The Texas native was making his first start in his home state against the Rangers.

"I had a lot of friends and family here," Humber said. "It was definitely nice to pitch well here."

Matt Harrison (12-6), who lost his second straight start, gave up five runs and seven hits in seven innings. The left-hander walked three and struck out four.

Josh Hamilton sat out after Rangers manager Ron Washington elected to give his slumping slugger a mental break. Hamilton is batting .145 in July and heard rare boos from his home fans after striking out twice Friday night.

Adrian Beltre moved into Hamilton's third spot in the batting order, and rookie Leonys Martin played left field.

The Rangers also shuffled the middle of their lineup. Nelson Cruz hit fourth for the second time in two years, David Murphy was in the fifth spot and Michael Young batted sixth.

Mike Napoli had a solo homer and an RBI groundout for Texas, which dropped its fifth in a row to the White Sox. Humber and three relievers held the Rangers to five hits.

Texas went 0 for 13 with runners in scoring position and 1 for 21 in the series.

"If we start swinging the bat with some runners in scoring position, we can turn this thing around," Rangers manager Ron Washington said. "That's what's killing us right now."

The White Sox had two rookies and backup catcher Tyler Flowers in the lineup, but offensive leaders Dunn and Konerko came through with the big hits to sink the Rangers.

Harrison allowed only a walk through three innings before Chicago broke through. Dunn singled off Ian Kinsler's glove at second base with one out in the fourth. Konerko followed with a 416-foot drive to left, his 17th home run of the season.

Konerko is 10 for 19 with three home runs and seven RBIs over his last five games.

The White Sox broke the game open with their three runs in the fifth.

After losing five in a row, the White Sox have responded by scoring 40 runs during their current winning streak.

"You have to zone (Harrison) up and have a plan on what you're doing," Dunn said. "If you get away from the plan, he's going to get you."

Young tripled leading off the seventh and Napoli followed with a walk that ended Humber's night.

Jesse Crain inherited the first-and-third jam. He struck out Martin and Craig Gentry, then got some help from his defense. Dayan Viciedo made a diving catch of Kinsler's looping fly in shallow left to end the inning.

NOTES: Chicago OF Alejandro De Aza (sprained left wrist) and SS Alexei Ramirez (bruised left hand) didn't play one day after being involved in a scary outfield collision. While neither injury is considered serious, White Sox manager Robin Ventura said De Aza likely wouldn't play Sunday, either. ... C A.J. Pierzynski missed his fourth straight game with a right oblique strain. ... Texas RHP Neftali Feliz will make his fourth rehab appearance Sunday for Triple-A Round Rock. He is expected to throw about 80 pitches. ... Chicago's Gavin Floyd (8-8) will face Texas' Scott Feldman (4-6) in the series finale Sunday.

Jonathan Rhys Meyers will be 'Dracula'

NBC has sunk its teeth into "Dracula." The network has ordered 10 episodes of the drama series, tapping?"The Tudors's"?Jonathan Rhys?Meyers to play the famous vampire in what NBC Entertainment president Robert Greenblatt?dubbed a "new version of the classic Bram Stoker" tale.

The series, which bypassed the traditional pilot stage, takes place in the 1890s and finds Dracula living a double life in London as an American businessman interested in bringing modern science to Victorian society. His true plan to exact revenge on those who burdened him centuries ago, however, is derailed when he falls in love with a woman who seems to be his reincarnated wife.

"Dracula"?unites Greenblatt -- who noted Tuesday morning at?the Television Critics Association (TCA)?summer press tour in Beverly Hills, Calif.?that he had other big announcements that weren't quite ready at the time of his executive session -- with his former star Meyers, whom he cast on the Showtime period drama and cast as Elvis Presley on the telepic?"Elvis."

"In the world of?"Twilight"?and?"True Blood"?and all the contemporized stories, we thought we'd go back to the original," he told reporters Tuesday at TCA, noting that the series would stay true to the time period but look toward the future.

"Dracula," a co-production from British Sky Broadcasting, Carnival Films & Television, Flame Ventures and NBCUniversal, hails from?Tony Krantz?("24,"?"Sports Night")?and former HBO Films president?Colin Callender?and writer/creator?Cole Haddon?(who will co-executive produce)?and will be produced for NBC stateside and the U.K.'s Sky Living. Gareth Neame?("Downton Abbey") and?Anne Mensah?are also on board, along with Reece Pearson, who will also serve as a co-executive producer.?

Additional castings and production details will be announced at a later date. Haddon is repped by ICM Partners and Anonymous Content.

The?"Dracula"?order comes as NBC is readying another supernatural-type drama in its reboot of?"The Munsters."?From?"Pushing Daisies"?creator?Bryan Fuller, NBC previewed the pilot for?"Mockingbird Lane"?this month at Comic-Con. A decision on the effort, which has received an order for additional scripts, is expected to come in the next month or so. Eddie Izzard?portrays Grandpa Munster, a Dracula-like figure, in?"Mockingbird Lane."

While pet owners across America and in states like Wisconsin, love their dogs, turns out having one may be more costly than expected. With more than 16,000 dog bite claims filed during 2011 alone, dog bites accounted for more than 33 percent of home insurance claims.

Every year an estimated 4.5 million people suffer dog bites. Of those individuals bit, the majority are children. A dog bite can result in serious and disfiguring injuries including puncture wounds and injuries to the face. Depending on the breed of dog and age of the victim, some dog bite and attack injuries may even result in death.

Nearly 20 percent of those individuals who are bit by a dog seek medical attention for their injuries. Some individuals may also take legal action against the dog owner by filing a personal injury claim. Due to the costs involved with litigation, most dog bite claims are settled outside of court with the average settlement amount totaling roughly $24,000.

Due to the prevalence and high costs associated with dog bite claims, some dog owners who also own homes may be denied coverage. Many smaller and independent insurance agencies will not insurance home owners who own specific breeds of dogs known to be more aggressive. These breeds include pit bulls, Rottweilers and Doberman pinschers.

Individuals who are bit by a dog may want to consider taking legal action. Dog bites can result in painful and disfiguring injuries that may require medical attention and plastic surgery. Likewise, individuals bit by a dog may seek to recover damages associated with emotional distress, pain and suffering.

Cruise Reviews, Ship Reviews by The Avid Cruiser | Where the Wild ...

It?s been an endless summer in the Midwest. As much as I love my sweet home Chicago, after weeks of sweltering triple digit temperatures, I?m ready for a break from summer in the city. Thankfully, I?ll be cooling off with my 12-year-old son, Charlie, aboard Holland America?s elegant and modern Oosterdam, a mid-sized ship holding nearly 2,000 passengers.

Chilling out in cooler climes is just the tip of the iceberg. For my scenery starved city kids, my travel goal is always to get them out into nature, unplugged from the electronics that seem to be such a natural part of our daily lives. I try to answer the call of the wild during vacation, and what could be wilder than Alaska? Eagles, bison and bears? oh my!

Along with checking out the wildlife, we?ll be exploring the kids? clubs and other teen/?tween activities onboard. Charlie will give you his 12-year-old opinion on just how kid-friendly our voyage is. Maybe we?ll even stir it up in a culinary class. Speaking of culinary adventures, I?ll make sure and give you a taste of Holland America?s newest epicurean delight? the Master Chef?s International Dinner. Held once during each cruise, it?s a cross-cultural tour showcasing signature dishes from around the world. I?ll let you know if this exotic menu is a 12-year-old?s recipe for a great meal, as well.

We?ll also be dining in high style when we enjoy ?An Evening at Le Cirque? at the intimate Pinnacle Grill. Offered once each cruise, it?s a menu inspired by the legendary Le Cirque restaurant?s award-winning cuisine. I?ll let you know whether Holland America?s version lives up to the legend.

Hope you?re hungry for more, because I?ll also be highlighting our shore excursions. One great way to get to know a port is through volunteering, or, as I like to call it, voluntouring. We?ll be doing just that in Juneau as part of the Whales and Glaciers Citizen Science Adventure, where we?ll be on an exploration vessel helping out with scientific data collection. It?s part of Holland America?s innovative Cruise with Purpose voluntouring initiative. Sign up for a Cruise with Purpose shore excursion and you?re not only having a great adventure, but you?re giving something back to the community as a volunteer tourist. I?ll let you know whether our citizen science whale-watching adventure measures up!

Catch us if you can when we?re in Ketchikan, because we?ll be taking a walk on the wild side. Charlie and I will be playing king of the mountain as we attempt to hike the 3,000 foot summit of Deer Mountain in the Tongas National Forest. The trailhead is only a half mile from the cruise port and I?m told if you?re lucky you?ll spot mountain goats, sitka deer, wolves, maybe even black bears. I?ve heard the mountain peak provides spectacular views of Ketchikan and the Alaskan wilderness. It?s a 5 mile roundtrip hike that takes about 4 hours, I also hear there?s still likely to be snow at the summit. I?m not promising we?ll make it to the top, but we?ll definitely be heading into the wild.

FOSS Patents: German appeals court clears Samsung's modified ...

The Oberlandesgericht D?sseldorf (Dusseldorf Higher Regional Court) just announced its decision on two appeals of decisions by the Landgericht (District Court) based in the same German city.

Oliver Voss, an editor of Wirtschaftswoche (a leading German business weekly), announced the outcome on Twitter:

  1. The appeals court upheld the lower court's denial of a preliminary injunction against the Galaxy Tab?10.1N, a modified version of the 10.1-inch tablet that Samsung's designers and lawyers jointly created in order to steer clear of violationg of Apple's asserted rights.

    The appeals court had previously affirmed a preliminary injunction against the original Galaxy Tab?10.1, identifying a violation not on the basis of Apple's asserted Community design (the EU equivalent of a U.S. design patent) but under German unfair competition law. As a result, the geographic scope of the decision was limited to Germany.

  2. Apple succeeded on another count. It won a preliminary injunction against the Galaxy Tab?7.7 on an EU-wide basis. It was previously already able to enforce the Galaxy Tab?10.1 decision against the Galaxy Tab?7.7, which has the same design but a smaller form factor (under German law, this is called a "kerngleicher Versto?", or "violation sharing the same core"). But with the appeals court's decision, it can now also prevent Samsung's Korean parent company (and, as a result, its different international subsidiaries) from selling the Galaxy Tab?7.7 anywhere else in the EU. Today's decision formally excludes Germany, but that's for the reason I explained.

    The lower court had originally entered an EU-wide preliminary injunction against the Galaxy Tab 10.1 affecting not only Samsung's German subsidiary but also its Korean parent company and, as a result, the Samsung group as a whole. It then modified that order so as to apply only to the German subsidiary, holding that Apple had not proven that the Korean parent company has an "establishment" in Germany. The appeals court, however, disagreed and found (already in the Galaxy Tab?10.1 decision) that Samsung's German subsidiary is effectively an establishment of the Korean parent company, even though it formally claims to be an independent legal entity.

Today's decision is still a ruling made on the fast track. It is, by definition, a preliminary decision. The final decision has not even been made by the lower court yet, and it will also be possible to appeal that one. In the full-blown main proceeding, Apple is targeting a total of five Samsung tablets (and in a separate case, ten Samsung smartphones). While the outcome of the main proceeding is likely going to be consistent with the appeals court's fast-track ruling, it's legally possible that the court changes mind.

Today's decision provides, on a preliminary basis, valuable clarification to both parties. Apple and Samsung have a better idea now of how similar to Apple's tablet computers Samsung's Galaxy devices may look without infringing in the opinion of German courts.

But today's decision won't have much of a bearing on the U.S. trial scheduled to start on Monday (July?30), though Apple may file a request for judicial notice with Judge?Koh, the effect of which would be merely psychological.

In the United States, Samsung will also have to decide, after the upcoming trial, which changes to the design of its Galaxy Tab line are necessary in order to avoid further infringement. The Galaxy Tab?10.1N could serve as a starting point for any designaround effort.

In the wake of the Jerry Sandusky child sex abuse scandal, Penn State officials removed the statue of head football coach Joe Paterno. He had been implicated in covering up the abuse.

His statue outside Beaver Stadium literally was larger than life ? 900 pounds of bronze and seven feet tall.

Now it?s been removed, lifted ignominiously by crane early Sunday morning to be stored ?in a secure location,? according to university officials. This inanimate object, it seems, had become another victim of a shocking child sex abuse scandal?that went on for years, apparently with at least some knowledge by Mr. Paterno.

?Contrary to its original intention, Coach Paterno's statue has become a source of division and an obstacle to healing in our University and beyond,? Penn State President Rodney Erickson said in a statement Sunday.

?For that reason, I have decided that it is in the best interest of our university and public safety to remove the statue and store it in a secure location,? he said. ?I believe that, were it to remain, the statue will be a recurring wound to the multitude of individuals across the nation and beyond who have been the victims of child abuse.?

In a way, it was a Solomonic decision. Remaining in place ? and without any name change, at least for now ? will be the campus library that bears Paterno?s name.

?The Paterno Library symbolizes the substantial and lasting contributions to the academic life and educational excellence that the Paterno family has made to Penn State University,? Mr. Erickson said. ?The library remains a tribute to Joe and Sue Paterno's commitment to Penn State's student body and academic success, and it highlights the positive impacts Coach Paterno had on the University. Thus I feel strongly that the library's name should remain unchanged.?

Over the years, the Paterno family had made large financial contributions to the university.

Coach Paterno?s fall from Penn State football grace came with the horrific reports of child sexual abuse committed over years by Paterno?s chief assistant and friend Jerry Sandusky.

Mr. Sandusky now awaits sentencing for his conviction last month on 45 charges of child sex abuse involving 10 boys over 15 years.

All along Paterno (who was in his 80s and died in January of problems related to an illness that his family had announced some time earlier) maintained that he had no idea that Sandusky was a pedophile whose abuse of many boys stretched over years.

Banks used to be in the business of gathering deposits and making loans. Today, they are in the business of gathering fees and making trades.

Being an American banker today means living under the thumb of regulators who demand that you lend money at extremely low interest rates, while trying to avoid making bad loans that would reduce your capital and potentially require a federal bailout. The bigger the bank, the greater the pressure.

In this environment, depositors are a nuisance unless you can extract hefty fees from them. You have to track their money and hold part of it in cash so you can meet withdrawal demands, and you can't lend most of the rest at very high rates anyway. When you do lend money, you must generate reams of paperwork to satisfy your examiners. If things go badly for borrowers, you can expect to be accused of "predatory" lending. And if you try to foreclose on loans in default, you had better make certain that all your paperwork is in order, lest the collateral that secures your capital - and your depositors' deposits - be lost amid charges of "robo-signing."

Yet bankers were not forced out of their traditional business by heavy-handed or clueless regulators. Years before the housing bubble burst and the financial crisis began, bankers willingly exchanged much of their slow-but-steady business for the faster-buck pursuit of fee and trading profits. Banking circa 2005 was a race to issue mortgages that could quickly be resold, in the case of high-quality borrowers, to Fannie Mae and Freddie Mac or, in the case of more dicey borrowers (the phrase "anyone with a pulse" was widely used), to private investors in the form of securities that were packaged on Wall Street. Banks could then seek to make additional profits by trading those same securities.

Traditional banking serves a very important economic purpose. By gathering idle cash and lending it to borrowers who can put it productively to work, banking makes society as a whole wealthier over time. It is a risky business model, because only a thin foundation of bank capital supports a big structure of loans and deposits, but the advent of federal deposit insurance and closer inspection bought decades of stability until the fast-buck boom went bust.

Now our post-recession economy is having trouble gaining steam, and one of the reasons is the anti-lending bias in today's banks.

Lately, however, regulators have started to pressure banks to cede some of their newer revenue sources. This might only inspire banks to find new ways to make quick money, but there is at least a chance that the new demands might lead banks back to their old way of doing business.

One area where banks are seeing restraints on their pursuit of fee revenue is in overdrafts. Regulations issued by the Federal Reserve Board in 2009 prohibit banks from processing debit card or ATM withdrawal charges that put a customer's account into the red and then charging that customer a fee on the overdraft unless that customer explicitly consents. Since then, many people have done just that, opting into overdraft protection programs that brought in $31.6 billion for banks last year, according to Moebs Services, a Lake Bluff, Ill., research firm. Around 15 million Americans overdraw their accounts more than ten times a year, each time paying overdraft fees ranging from $25 to $35, the firm said. (1)

Richard Cordray, director of the Consumer Financial Protection Bureau (CFPB), has launched an inquiry into these overdraft protection programs, looking at marketing materials that may mislead customers into consenting to "protection" that could cost them hundreds of dollars in avoidable fees every year.

Last week, four people with knowledge of the inquiry told reporters that investigators are examining the practices of nine U.S. banks, including national players JPMorgan Chase & Co., Wells Fargo & Co. and Bank of America Corp.; regional players U.S. Bancorp, Regions Financial Corp., and PNC Financial Services Group Inc.; and three others that were not named.

In another development last week, the Federal Reserve and four other U.S. agencies essentially admitted that the so-called Volcker Rule, restricting banks' proprietary trading, is such a mess that they will not be able to actually write the regulations needed to implement it until after the planned July 21, 2012, compliance deadline.

According to the Federal Reserve, banks will now have two additional years to comply with the as-yet-unwritten rule. Now they need only make a "good faith" effort to "conform" their activities and investments to the still-undefined standard. (2)

Like most owners of small businesses, I am not directly affected by mega-issues such as the Volcker Rule. I don't need my bank to provide me with foreign currency hedges or interest rate swaps. I do, however, need my bank to provide me with credit and to hold my company's cash. And, like many business owners, I am seeing the results of the tighter credit environment firsthand.

Back in 2008, when the financial crisis first hit, I drew down a $50,000 credit line that had been issued to our company at 0.75 percentage points above the prime rate. With credit markets freezing up and the government's response still uncertain, I sensed that this was a use-it-or-lose-it situation. I kept the money borrowed more or less continually since then, even though the business had more than enough cash (earning close to zero) to pay it off. I was willing to spend about $2,000 a year in net interest cost to ensure that the funds would be available if things got really tight.

Recently, the bank told me it was raising the interest rate on my credit line to 3.25 percent above the prime rate (which is also at 3.25 percent right now), bringing the total cost to 6.5 percent. As any savvy banker might have predicted, rather than paying nearly $3,125 in annual interest costs, I repaid the credit line. My bank's profit on the transaction went from $2,000 to zip.

In normal economic times, that would have been bad news for the bank. In our present world, however, the bank was probably happy to have my line of credit paid off. It meant one less "risk" in the eyes of regulators, even though the bank (which sees our cash inflows and outflows) knows that our business is good and our cash flow is stable.

In March, Bank of America announced that it was looking into ways to restructure checking account fees in order to charge more. JPMorgan Chase and Wells Fargo similarly introduced new programs, which impose monthly maintenance fees for many customers, in 2010 and 2011. Wells Fargo's retail division relied on fees, including overdraft fees, for nearly a quarter of its net income, or $4.3 billion, in 2011, according to financial disclosures, Bloomberg reported. (1)

It's going to be very difficult to get normal economic growth in an abnormal situation, and there is a lot about the financial system that is abnormal. Depositors are paid almost nothing for their deposits, borrowers pay unrealistically low rates for credit that is unreasonably hard to get, and banks are not particularly interested in traditional banking. Just getting things back to normal would be a major step forward.

  • Hakkasan has been in the worlds top 50 restaurants for a couple of years now.

I?ve eaten at a good number of Michelin Star restarants, on a good number of continents. I?d like to think that I have a general understanding of what I should expect from a place listed in the guide. In my opinion, Hakkasan was enormously over priced with poor service and cooking that relied on super high quality ingredients to impress.

The decoration of Hakkasan is very impressive, but with bouncers on the door, it opens to a very strange feel to begin with. The lights are VERY low for a restaurant. From the minute I walked in, I had a feeling that this was going to be a very expensive meal. There was 8 of us visiting, and I was looking forward to seeing how a restaurant like this could handle a large table.

To begin with, some drinks are the impressively stocked bar. The bar wasn?t busy but service was slow and abrupt. After waiting a while for the barmen to stop talking, I eventually got a drinks menu from them. He wasn?t helpful with a suggestion of a drink that I asked for and insisted on taking an extra card to start a tab, in addition to the one which they insisted was taken for the table. The only drink I had from the bar was beer, so no comments on the quality of the cocktails or anything else there.

The tables are nicely laid, very minimalistic. Again, the restaurant is extremely dark, and I?ve lightened these photos significantly just so that you can get a look at the place. The tables are quite close together though, don?t expect a huge amount of space between each of them. The restaurant as a whole is very big though.

My main meal was one of the most expensive ?normal? main dishes on the menu. Hakkasan Wagyu Beef at ?65 for the meat. Sides are extra. The quality of the beef was astonishing, probably the softest beef I?ve ever had ? but at this price I would expect nothing less. Its listerally marinated & cooked. In my opinion, this is not Michelin Star cooking ? its just cooking with extremely high quality ingredients. I asked for my beef to be rare, and as you can see from the picture, there are parts of the beef which are lovely and rare, with others decidedly on the medium side.

Our food did not come up at the same time, not even close. My beef was first, and I waited for everyones else food to be brought up, one dish at a time. Soon after, the side dishes were brought up. Getting extra drinks was an effort, having to flag down the waiter, followed by more waiting.

However, don?t think that ?65 is a lot of money to spend on a single dish in this place? They have dishes which cost over ?400. I?m not adverse to spending lots of money on food ? I have a table at Noma next week ? the worlds number one restaurant, and will be dropping over ?200 per person on that meal. However, the amount of effort that Rene and his team put into each and every meal warrants that kind of price.

One of the things which I really didn?t like about Hakkasan was the service and the staff. If a restaurant is selling a dish for ?400+ I would expect the staff to dress is something more than just cheap black t-shirts. ?You can also see in the kitchen, that considering the restaurant was full at this time, its doesn?t exactly appear under pressure to get the meals out.

Overall, I was really disappointed with Hakkasan. Yes the quality of the ingredients used is some of the best in the world, but the price issues, the staff and the service let the experience down. I do not expect to be going back any time soon, or recommending anyone else goes there. For a lot less money you can have a meal which is significantly more enjoyable.

What might be hiding in Romney's tax returns?

WASHINGTON (Reuters) - Mitt Romney tried again on Thursday to shift the campaign conversation away from his refusal to disclose more of his tax returns, raising questions about what may be in them.

While Romney accused President Barack Obama of demonizing business success by hounding the Republican challenger over the issue, tax experts were speculating about what might be in Romney's undisclosed returns.

So far he has released only his 2010 return and a draft of his 2011 return. He has pledged to release the full 2011 return when it is ready. He has also made disclosures to election officials that shed some light on his personal finances.

Formerly governor of Massachusetts, Romney co-founded private-equity firm Bain Capital, a highly successful investment house, and is one of the wealthiest individuals ever to run for the White House.

Presidential candidates are not required to disclose their tax returns, but it has become common practice. Romney's father released 12 years of returns when he ran for president in 1968.

Obama, whom Romney presumably will challenge in November, has released returns back to 2000.

DID HE PAY LOW TAXES IN 2009?

Could it be that Romney paid very little in taxes in 2009 or earlier?

Romney's tax return information released in January showed he paid a 13.9-percent effective tax rate in 2010 and expected to pay a 15.4-percent effective rate on his 2011 income.

Those rates are far below the 35-percent top tax rate for wages, chiefly because Romney gets most of his income from investment gains, which are taxed at a rate of 15 percent.

The 2008 financial crisis hammered many wealthy investors. Some tax experts speculate the crisis may have generated large capital losses for Romney that, carried forward into 2009, might have sharply reduced his tax bill for that year.

Romney campaign spokeswoman Andrea Saul said on Thursday that there has been no year in which Romney paid zero taxes.

Romney might have had other types of income in 2009 and earlier that could not be offset by capital losses, other experts said.

"The number everyone is focused on is, of course, the effective tax rate," said University of Notre Dame accounting professor Brad Badertscher.

Obama reported paying effective tax rates of about 26 percent in 2010 and about 20.5 percent in 2011.

WHAT ABOUT THAT MASSIVE IRA?

Romney's individual retirement account, or IRA, holds as much as $101 million, despite an annual contribution limit of about $6,000. How could it have gotten so large?

Some tax experts suggest its value has been bloated by stock acquired by Bain at rock-bottom prices. The IRA holds some of Romney's most lucrative investments, according to a financial disclosure form filed with election officials last August.

Pre-2010 tax returns might reveal little about the IRA, however, since personal returns only show contributions and withdrawals in a given year, and would not show, for example, the values of partnership interests.

WIFE'S SWISS BANK ACCOUNT

Ann Romney, the candidate's wife, held a trust with a $3 million bank account at UBS AG, the Swiss banking giant that in 2009 agreed to settle U.S. charges that it helped Americans evade taxes. The account was closed in 2010, the Romney campaign said.

University of Southern California Professor Edward Kleinbard wondered if the Swiss account generated income for the Romneys in ways they would rather not disclose, perhaps for instance by investing in foreign currencies against the U.S. dollar.

"Most presidential candidates don't think it appropriate to bet that the U.S. dollar will lose value by speculating in Swiss francs, which is basically the rationale offered by the trustee of Romney's 'blind' trust for opening this account," Kleinbard wrote in a Los Angeles Times opinion piece on Wednesday.

The trustee in charge of the Swiss account said it was an attempt to diversify investments.

CARRIED INTEREST

Romney earned about $13 million in income over the past two years from "carried interest," a form of earnings available to private-equity firm partners and taxed at the 15 percent investment tax rate, rather than the higher rate on ordinary income, according to the campaign.

The carried interest provision of the U.S. tax code has repeatedly been targeted for elimination by Democrats who call it unfair, but the private-equity industry has fought repeal.

WHAT ABOUT OFFSHORE INVESTMENTS?

In 2010, Romney and his family had substantial income from private equity, venture capital and other funds, according to disclosures in August to the Federal Election Commission.

Much of this income came from funds organized by Bain Capital. Some of the funds and affiliates are in tax havens such as the Cayman Islands, Bermuda and the U.S. state of Delaware.

"The so-called offshore account in the Cayman Islands, for instance, is an account established by a U.S. firm to allow foreign investors to invest in U.S. enterprises and not be subject to taxes outside of their own jurisdiction," Romney said in a recent interview in National Review magazine.

The tax returns released thus far also show investments in places such as Luxembourg and Switzerland.

No one is claiming these investments were illegal, but the use of offshore tax havens could hurt Romney in the campaign.

Gangster Squad Trailer: Pulled from Theaters in Face of Dark Knight Rises Massacre


In the wake of today's horrific Dark Knight Rises shooting in Colorado, Warner Bros. has chosen to pull the trailer for another movie out of theaters.

The preview for Gangster Squad, which has been online since May and is posted below, was NOT played prior to this morning's Batman feature and has NOT been attached to most of The Dark Knight Rises screenings around the country.

Still, one scene does depict mobsters opening fire inside a movie theater and, with the spot scheduled to start running nationwide this weekend, the studio thought it was inappropriate to air at such a time.

Gangster Squad will open on September 7. It stars Sean Penn, Ryan Gosling, Emma Stone and Josh Brolin and centers on a LAPD unit assigned to rid Los Angeles of organized crime in the 1940s.

    David Ortiz Injury: Red Sox DH Placed On DL With Strained Right Achilles Tendon

    BOSTON -- The Boston Red Sox placed designated hitter David Ortiz on the 15-day disabled list with a strained right Achilles tendon before Wednesday night's game against the Chicago White Sox.

    Manager Bobby Valentine said a second opinion concurred with the team's original report. Ortiz was injured rounding second base in Monday night's win.

    Valentine said it would be a week to 10 days before Ortiz resumes playing, so the team elected to put him on the DL.

    Ortiz has 23 homers and 58 RBI, and is currently on an 11-game hitting streak. He also has at least a hit and a walk in 10 straight games, breaking Ted Williams' club record set in 1950.

    To fill his spot on the roster, Boston recalled Mauro Gomez from Triple-A Pawtucket.
